Please read these Terms of Service ("Terms") carefully before using the GAUGE mobile application ("App") and related services operated by GAUGE ("we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our App.

2. Description of Service

GAUGE is an AI-powered mobile application that provides:

  • Style analysis and recommendations based on photos
  • Personalized size recommendations based on body measurements
  • Outfit building and wardrobe management tools
  • Shopping recommendations with affiliate links to retailers
  • AI-powered chat assistance (Premium feature)

3. Eligibility

You must be at least 13 years old to use our App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App. By using the App, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and current

4. User Accounts

4.1 Account Creation

You may be required to create an account to use certain features. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or use of your account.

5. Subscription and Payment Terms

5.1 Free Tier

Our App offers a free tier with limited features, including:

  • 10 style checks
  • Up to 20 wardrobe items
  • Basic outfit builder

5.2 Premium Subscription

Premium subscriptions are available for $6.99 per month and include:

  • Unlimited chat sessions with AI tailor
  • Unlimited style checks
  • Unlimited wardrobe items
  • Perfect fit recommendations
  • Favorite outfit combinations
  • Priority AI processing
  • Session history

5.3 Payment Processing

Subscriptions are processed through:

  • Apple App Store: Payments are processed by Apple. Subscriptions are managed through your Apple ID account settings.

We do not directly process or store your payment information.

5.4 Subscription Terms

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You will be charged the subscription fee to your Apple App Store account
  • Cancellation must be done through your Apple App Store account settings
  • No refunds are provided for partial subscription periods
  • We reserve the right to change subscription prices with 30 days' notice

5.5 Refund Policy

Refund requests are handled according to Apple App Store policies. Contact Apple support for refund requests. We do not process refunds directly.

6. User Content

6.1 Content You Provide

You retain ownership of all content you upload to the App, including photos, measurements, and wardrobe information ("User Content").

6.2 License to Use

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Use, store, and process your User Content to provide our services
  • Share your User Content with third-party AI services (e.g., Anthropic) for processing
  • Display your User Content within the App

This license terminates when you delete your User Content or account, except for content we are required to retain for legal purposes.

6.3 Content Restrictions

You agree not to upload content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Is offensive, harmful, or inappropriate
  • Contains malware or malicious code
  • Impersonates another person or entity

6.4 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

7. AI Services and Third-Party Services

7.1 AI Processing

Our App uses Anthropic's Claude AI to analyze photos and provide recommendations. By using our App, you acknowledge that:

  • AI analysis may not always be accurate
  • Recommendations are suggestions, not guarantees
  • We are not responsible for AI processing errors
  • Your photos are processed according to Anthropic's privacy policy

7.2 Affiliate Links

We may provide affiliate links to retailers. We may receive compensation when you make purchases through these links. We are not responsible for:

  • The quality, availability, or pricing of third-party products
  • Third-party websites' privacy practices or terms of service
  • Any transactions between you and third-party retailers

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, functionality, and content (excluding User Content), is owned by GAUGE and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal device
  • Use the App for personal, non-commercial purposes

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract source code
  • Use the App for commercial purposes without permission
  • Remove or alter copyright notices

9. Prohibited Uses

You agree not to:

  • Use the App for any illegal purpose
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorized access to the App or related systems
  • Use automated systems to access the App (scraping, bots, etc.)
  • Impersonate another person or entity
  • Harass, abuse, or harm other users
  • Transmit viruses or malicious code

10. Disclaimers

10.1 Service Availability

The App is provided "as is" and "as available." We do not guarantee that:

  • The App will be available at all times
  • The App will be error-free or uninterrupted
  • Defects will be corrected
  • The App is free from viruses or harmful components

10.2 Recommendations and Advice

Style recommendations, size suggestions, and outfit advice are provided for informational purposes only. We do not guarantee:

  • The accuracy of AI-generated recommendations
  • That recommended sizes will fit perfectly
  • That outfit suggestions will be appropriate for all occasions
  • The availability or quality of recommended products

You are responsible for making your own decisions about purchases and style choices.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid for the App or subscription in the 12 months preceding the claim
  • We are not responsible for any loss or damage resulting from:
    • Your use or inability to use the App
    • Errors or omissions in the App
    • Third-party products or services
    • Unauthorized access to your account
    • AI processing errors or inaccuracies

12. Indemnification

You agree to indemnify, defend, and hold harmless GAUGE and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any law or rights of others
  • Your User Content

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

  • Uninstalling the App from your device
  • Cancelling your subscription (if applicable)
  • Deleting your account through App settings

13.2 Termination by Us

We may suspend or terminate your access to the App immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse or misuse the App
  • Fail to pay subscription fees (if applicable)

13.3 Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • We may delete your account and User Content
  • You remain liable for all charges incurred before termination
  • Sections of these Terms that by their nature should survive will survive

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

14.2 Informal Resolution

Before filing a claim, you agree to contact us at support@gaugestyle.app to attempt to resolve the dispute informally.

14.3 Binding Arbitration

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you a notification (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GAUGE regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

16.4 Assignment

You may not assign or transfer these Terms or your account. We may assign these Terms without restriction.
